We, the undersigned, hereby do protest the Yates Occupancy Tax Law (YOTL) recently levied by the Yates County Legislature against cottage renters in Yates County and specifically targeted at lakefront properties on Canandaigua, Keuka and Seneca Lakes, all without due process, appropriate announcement, fair and equitable taxing, conducting hearings or soliciting input of the parties affected, and potentially with issues of conflict of interest. We ask that the Yates County Legislature do the following: 1. Immediately suspend any application of YOTL to cottages and private houses and homes for calendar year 2008. 2. Promptly amend the YOTL to specifically exclude and exempt those property owners who have three or fewer rental units in Yates County. 3. Promptly decriminalize any and all violations of YOTL back to the time of enactment of the YOTL, and to such time as the law is amended under #2 above, for property owners of three or fewer rental units in Yates County. 4. Eliminate any and all fines and penalties on property owners of three or fewer rental units in Yates County related to any non-compliance with any terms of YOTL. We the undersigned do hereby petition the Yates County Legislature to take heed to this petition, as time is of the essence to property owners trying to rent for the 2008 season, who will be injured financially in this year and in subsequent years by a failure to have an immediate suspension as provided above, and who hereby put the Yates County Legislature on notice, that in the absence of receiving such relief, their actions and this Occupancy Tax will cause lost rentals and other expenses and damages, to which we shall look, separately or as a class, to Yates County for equitable relief.
